باب: قاضی ( جج ) سے فیصلہ میں غلطی ہو جائے تو کیسا ہے ؟
CHAPTER: Regarding The Judge Who Is Mistaken.
Narrated Buraydah ibn al-Hasib: The Prophet صلی اللہ علیہ وسلم said: Judges are of three types, one of whom will go to Paradise and two to Hell. The one who will go to Paradise is a man who knows what is right and gives judgment accordingly; but a man who knows what is right and acts tyrannically in his judgment will go to Hell; and a man who gives judgment for people when he is ignorant will go to Hell. Abu Dawud said: On this subject this is the soundest tradition, that is, the tradition of Ibn Buraidah: Judges are of three types.
بریدہ رضی اللہ عنہ سے روایت ہے کہ نبی اکرم صلی اللہ علیہ وسلم نے فرمایا: قاضی تین طرح کے ہوتے ہیں: ایک جنتی اور دو جہنمی، رہا جنتی تو وہ ایسا شخص ہو گا جس نے حق کو جانا اور اسی کے موافق فیصلہ کیا، اور وہ شخص جس نے حق کو جانا اور اپنے فیصلے میں ظلم کیا تو وہ جہنمی ہے ۔ اور وہ شخص جس نے نادانی سے لوگوں کا فیصلہ کیا وہ بھی جہنمی ہے ۔ ابوداؤد کہتے ہیں: یہ یعنی ابن بریدہ کی تین قاضیوں والی حدیث اس باب میں سب سے صحیح روایت ہے۔
Narrated Buraidah: The Prophet صلی اللہ علیہ وسلم as saying: Judges are of three types, one of who will go to Paradise and two to Hell. The one who will go to Paradise is a man who knows what is right and gives judgement accordingly; by a man who knows what is right and acts tyrannically in his judgement will go to Hell; and a man who gives judgement for people when he is ignorant will go to Hell. عمرو بن العاص رضی اللہ عنہ کہتے ہیں کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: جب حاکم ( قاضی ) خوب سوچ سمجھ کر فیصلہ کرے اور درستگی کو پہنچ جائے تو اس کے لیے دوگنا اجر ہے، اور جب قاضی سوچ سمجھ کر فیصلہ کرے اور خطا کر جائے تو بھی اس کے لیے ایک اجر ہے ۱؎ ۔ راوی کہتے ہیں: میں نے اس حدیث کو ابوبکر بن حزم سے بیان کیا تو انہوں نے کہا: مجھ سے اسی طرح ابوسلمہ نے ابوہریرہ رضی اللہ عنہ کے واسطہ سے بیان کیا ہے۔
Narrated Abu Hurairah: The Prophet صلی اللہ علیہ وسلم said: If anyone seeks the office of judge among Muslims till he gets it and his justice prevails over his tyranny, he will go to Paradise; but the man whose tyranny prevails over his justice will go to Hell.
ابوہریرہ رضی اللہ عنہ کہتے ہیں کہ نبی اکرم صلی اللہ علیہ وسلم نے فرمایا: جو شخص مسلمانوں کے منصب قضاء کی درخواست کرے یہاں تک کہ وہ اسے پا لے پھر اس کے ظلم پر اس کا عدل غالب آ جائے تو اس کے لیے جنت ہے، اور جس کا ظلم اس کے عدل پر غالب آ جائے تو اس کے لیے جہنم ہے ۔
Ibn Abbas said: If any do fail to judge (by the light of) what Allah has revealed, they are (no better than) unbelievers up to wrongdoers. These three verses were revealed about the Jews, particularly about Quraizah and al-Nadir.
عبداللہ بن عباس رضی اللہ عنہما کہتے ہیں آیت کریمہ «ومن لم يحكم بما أنزل الله فأولئك هم الكافرون» جو اللہ کے حکم کے موافق فیصلہ نہ کریں وہ کافر ہیں اللہ تعالیٰ کے قول «الفاسقون» سورة المائدة: ( ۴۴، ۴۵، ۴۷ ) تک، یہ تینوں آیتیں یہودیوں کے متعلق اور بطور خاص بنی قریظہ اور بنی نضیر کی شان میں نازل ہوئیں۔
